1. Scope of Services
THIRD KAGURA Pty Ltd (“THIRD KAGURA”, “we”, “us”, “our”) operates primarily as a DJ booking agency and creative coordination service, and may also provide event production support and related services.
Our services may include, but are not limited to:• DJ and artist booking and coordination • Agency and liaison services between clients and independent DJs • Event and production planning support • Creative and operational coordination related to performances
2. Independent Contractor Relationship
All DJs and artists introduced, booked, or coordinated by THIRD KAGURA are independent contractors or are supplied via partner agencies. They are not employees, partners, or representatives of THIRD KAGURA.
THIRD KAGURA acts solely as an intermediary and coordinator unless otherwise expressly agreed in writing.
3. Provisional Bookings (Tentative Holds)
Provisional or tentative bookings (“holds”) may be placed upon request. A booking is not confirmed until:• Written confirmation is provided, and • Required payments (deposit or full payment) are received.
THIRD KAGURA reserves the right to release tentative holds without notice if confirmation or payment is not received within the agreed timeframe.
4. Fees and Payments
Unless otherwise agreed:• Payment is required at the time of contract confirmation. • Payments may be made via bank transfer or credit card. • THIRD KAGURA may charge applicable transaction or processing fees where relevant.
Failure to complete payment may result in cancellation of services.
5. Cancellation Policy (Client-Initiated)
DJ Booking / Agency Services
• Cancellation 14 days or more prior to the event date: Deposit is forfeited.
• Cancellation within 14 days of the event date: No refund.
Artist-specific terms may apply, including additional cancellation fees, which will be communicated prior to confirmation.
6. Force Majeure
In cases of force majeure, including but not limited to:• Severe weather • Accidents • Illness • Government restrictions
THIRD KAGURA will, where possible, offer rescheduling. Refunds are not guaranteed and are assessed on a case-by-case basis.
7. Safety, Conduct, and Right to Suspend Performance
A DJ or artist may suspend or terminate services immediately if:• Violent, intoxicated, or dangerous behaviour occurs • Equipment is at risk of damage • Adequate power supply or safe setup is not provided • The event involves or may involve illegal activity
In such cases, no refund will be provided.
8. Marketing, Photography, and Media Use
Photography or videography during events will only be used for THIRD KAGURA’s promotional purposes with prior agreement.
Where promotional cooperation is agreed:• Such usage may be included as part of a discounted promotional plan.
Without explicit agreement, client and guest privacy will be fully respected.
9. Limitation of Liability
To the maximum extent permitted by law:• THIRD KAGURA is not liable for indirect or consequential loss. • Liability is limited to the amount paid for the relevant services.
Nothing in these Terms excludes rights under Australian Consumer Law.
10. Insurance Disclosure
THIRD KAGURA maintains:• Public & Products Liability Insurance up to AUD 5,000,000 • Cyber Liability Insurance up to AUD 100,000
This disclosure does not constitute a guarantee of coverage for all circumstances.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales.
12. Amendments
THIRD KAGURA reserves the right to amend these Terms at any time. The version published on our website shall prevail.
